Terms of Use for KC TalkBoard

These Terms of Use (“Terms”) govern your access to and use of the KC TalkBoard mobile application (“KC TalkBoard” or “the App”). By downloading, installing, or using KC TalkBoard, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility and Use
You must be legally capable of entering into binding agreements in your jurisdiction to use KC TalkBoard. The App is intended for individual, non-commercial use.
By using the App, you agree not to:
- Interfere with the integrity or performance of the App;
- Copy, modify, distribute, or reverse-engineer any part of the App;
- Use the App in violation of any applicable law or regulation.
2. Features and Access
KC TalkBoard does not require you to create an account or provide personal information. Use is managed anonymously, and your preferences are saved locally on your device.
All features of the App require a purchase to access. Without a valid in-app purchase or subscription, functionality is limited or disabled.
We reserve the right to discontinue, disable, or remove the App from the app stores at any time without notice or liability.
3. Purchases, Subscriptions, and Refunds
KC TalkBoard offers features via one-time purchases or auto-renewing subscriptions. All transactions are processed through the Apple App Store or Google Play. We do not collect or store payment information.
- Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Refunds: No refunds are issued directly by us. All refund inquiries must be directed to the respective app store provider and are subject to their terms.
KC TalkBoard currently offers a purchase option (“Lifetime Access”) that unlocks the full features of the app without a recurring subscription.
Lifetime Access grants usage rights for the current version of the app and any updates we choose to release. It does not guarantee that the app will be maintained, updated, or supported indefinitely. We may choose to modify, stop updating, or remove the app from the store at any time, with or without notice. Purchasing Lifetime Access does not entitle users to future compatibility with new devices, operating systems, or features. Lifetime Access refers to the lifetime of the app itself — not the lifetime of the user.
All Lifetime Access purchases are final. We do not offer refunds for any reason, including if the app is later discontinued, changed, or removed from sale.
4. Data Practices
KC TalkBoard does not collect personally identifiable information. An anonymous identifier is used to manage access, and app preferences are stored only on your device.
No data is transmitted to external servers. The App does not use analytics, advertising services, or crash reporting tools.

5. Software Updates
We may update KC TalkBoard at our discretion. Updates may include improvements, fixes, or other changes. By continuing to use the App after an update, you agree to any changes to these Terms.
We also reserve the right to delay or discontinue future updates, with or without notice.
6. No Warranty
KC TalkBoard is provided “as is” without any warranties—express, implied, or statutory. We do not guarantee availability, reliability, or accuracy, and disclaim all warranties to the fullest extent permitted by law.
7. Limitation of Liability
To the extent allowed by law, we are not liable for any indirect, incidental, or consequential damages arising from the use—or inability to use—KC TalkBoard, including data loss or performance issues.
8. Termination
We may suspend or terminate access to KC TalkBoard at any time, with or without notice, particularly in cases of misuse or violation of these Terms.
9. Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Alabama.
10. Pricing Changes
We reserve the right to modify subscription fees at our sole discretion and at any time. Any changes to pricing will apply at the start of the next billing period following the change.
KC TalkBoard does not provide advance notice of fee changes. By continuing to use the App after a subscription fee change takes effect, you agree to pay the updated fee amount. If you do not agree to the new pricing, you must cancel your subscription before the start of the next billing cycle.
